I-485 denied with no notice - Please help

Mine is EB3 with PD June 2001 and I-485 was applied with RD of Oct 2002.

The online case tracking system has the status of case received and pending

Meanwhile, a call to USCIS revealed that they had denied my I-485 in Nov, 2005 and a letter was sent to the attorney's office.Attorney's office denies any letters sent to them.

How can the case be denied with out any notice? I did not receive any notice myself.i just learnt about this when I called TSC IO on monday.I called them again today but they said the same thing that my case had been denied and it has been closed in NOv 2005

But I did a FP appt in Jan 2006 though.Also my case status still says "Case received and Pending".Also there was an LUD on 03/27/2007 when I did a address change.

I have been asked to refile I-485 now by TSC IO.

Please let me know your suggestions.

The lawyer has contacted USCIS about what is the status of my case and the reason for Denial.He wants me to wait 6 to 8 weeks for the reply.They think they may have the wrong status on my case and nobody has looked into my case so far.My reciept date is pretty old .So I am pretty sure somthing fishy is going on with my case.I took a InfoPass appt for next week.My biggest confusion is how come the case status still says "case received and pending".But two of the IO's I talked to said the same thing that my case was denied.

From what you've said TSC IO told you complete bullshit.
I cannot imagine FP appointment 3 months after denial. It's just plain not possible. And current status says "case received and pending".

The only explanation is just TSC IIOs became so tired of the phone calls they make all kind of jokes with immigrants to brag about it.

The right thing would be to ask IIO name and id to keep them responsible for their words.

I suggest everyone ask IIOs for their names and ids. Then we can compile the data. But I doubt they'll tell us.


p.s. I'm thinking about starting recording the phone calls with IIOs. Need to double check all legality things afaik just saying to them "this phone conversation is recorded" prior to asking the questions should be enough. *tired of bullshit*

Now two IIOs. Hmmm. Looks more complicated. Anyway you'd better do a snapshot of the HTML page with case status (not a proof at all but better than nothing) and record case status from their phone system.

What numbers you used to call TSC thier phones are out of order ,214 381 1423 and 214 7677769 ..

I just want to make sure if you called right place also when you give them your case number ask them in return what name do they see and tell them politely that I'm just concerned if its spelled properly..

I had this exp last time I gave them my eac number , without even accessing the database he said your case still in the process then I asked can please repeate the Lname Fname on the file . he said thier systems are slow he cant see that info..

That's why It concerns me a lot because I heard the same thing from two IO's.I talked to one on Monday and one Today.I took a screenshot of the current status which says "case received and pending".Dont you think the status should read "Denied" if my case was denied.
Should I also have gotten a denial notice?? I never received one either
 
What about EAD and AP? You must have renewed them at least once or twice since November 2005. Those would not have been approved if your I-485 was denied back then.
 
Jackolantern made a good point. your EAD and APs will not have been approved if your I-485 was denied.I guess the IOs are just giving you incorrect information.
 
I have always been on H1B for past 9 years.Never applied for a EAD or AP.My last H1B got approved in Dec 2005 but USCIS says they denied my I-485 in Nov 05.It is very confusing.My guess is maybe they sent an RFE in Nov 05 and my attorney did not respond and so they could have denied in Dec 05.But they say denial notice was sent to attorney in nov 05
 
jay2007 - yes, you're right, MTR can be done only within 30 days of denial...dont waste time..quickly check with a good attorney...why not talk to Rajiv Khanna? He has a good track record

Is your I-140 approved ?

Do you have any history of denial in past ? ( from different company etc ?) before this application.

What I have seen is, if you have any history of denial before... their software shows that current application ( based on A # ) shows that your application is denied, but really current application was not denied. I am pointing out at their software...

Ask attorney to initiate/call for Status request.

MTR = Motion To Reopen

It allows you to reopen your case once it's closed. But one can only do it within certain time period after the case is closed.
