i had a very simple case. my wife, a US citizen, filed petition for me in US, i was working there on EAD's. After 3 years we got our interview. Due to child-birth we were/ are in India, and we got the interview date close to my wife's delivery date. I had sent couple of letters requesting re-scheduling the interview date, but we got no response......we had to carry on with our plans...
now, while i am travelling on my travel documents (AP), i got a letter for USCIS in that my I-485 and my wife's I-130 has been denied(because, we did not appear for the interview and they did not have proof of illness..... cancelling my travel documents & EAD.....
now, i'm wondering what my options are:
1. I have appealed this denial with all the proof of the documents and letters i had submitted earlier alongwith the return receipts, etc......does anybody have any information about appeals to denials and how effective are they ?
2. Can I go for Direct Consular Filing (yes, my wife's been here for more than 60 days).....can i do it in the Bombay Consulate ? or do i have to do it in New Delhi ?
