I-485 denied - options, Ginnu, The Real Canadian pls help

hi all,

my friends I-485 was denied (life act) and an appeal was filed in oct 2006. The appeal is pending. he now wants to file h-1b. can he apply for change of status or he has to do new h1-b.

also what is his current status? appeal pending 485?
