This thread serve the people, whose I-485 got denied, applied MTR and waiting USCIS decision. We will keep live this thread.

My details:
I-485 denied on 01/31/2005.
Received denial letter on 02/03/2005.
Applied MTR on 02/15/2005
Cheque cashed on 02/23/2005
290A ND: 02/22/2005

Once you file the MTR, how many days one can expect the "condions of denial" to be removed?

what is your status with respect to EAD while the time between receiving the denial letter and filing the MTR?

What is your status with respect to EAD, after filing MTR?

Mine is a retorgression case. Will the priority dates still apply to my case once after filing MTR they are convinced that they made a wrong decision. How would the whole thing work?

I have received the letter of denial. But my online status has not changed yet, is that normal.

I would infact prefer that they do not change the online status. Since my parents have my EAC number and they do check it once in a while. I dont want them to know about this.

Please comment.

How did you know that your case was denied ( or did not) before you actually recieved denial notice.

Notice of intent to deny

I think you have mentioned that your attorney received the same thing.
Its like RFE but with more harsh lanquage and time to respond is limited to 30 days.

My attorney had received the RFE. I know its definitely RFE becuase I got a copy of it. They had asked for 2 years of W2's and my attoney didnt send it atleast thats what i think from the denial letter i received.

Why would they not send me a NOID before sending me a denial straight. DAMN IT!!!!!

the way i came to know abt my I485 denial...

i had applied for EAD renewal thru efile...i didn't get receipt notice for more than 30 days....but i went to local office and did my fingerprinting and photo.
so to know abt my EAD status i called up and came to know that my I485 got denied. It was denied on 12/16/04 and got the news only on 1/21/05.
Then my husband whose is the primary called for his I 485 status and got his denial info too.... both of our cases were denied on 12/16/04.
then we kept calling again and again to get the denial notice.
BTW, our original lawyer screwed up us saying that she never received any original denial notice which was sent immediately after our denial on 12/16/04.
so we had to call USCIS directly to get our denial notice copy.
Our MTR was filed only after like 50 days after the date of denial due to this lawyer mess up....
Now we have gone thru new lawyer.
Hoping for good to happen....

Did you see any LUDs on I-485 approval after NOID reply?

After NOID was replied LUD have changed 12/23;12/24;12/27;12/28;12/29
The reasin for NOID: They think that i overstayed beyond 180 days, bz first I filed for B1 extension for 6 months ( and was waiting for approval for 12 months) while having pending application with USCIS I filed for change of status (J1). It was approved later. Now they claim that my I-94 has gap...
They ignored several internal memos. I also submitted letter from my University with the admittence of their fault in delay of switching of my status

Did you try to contact VSC? generally after RFE reply, they do approve the case within 60 days. You can give call to VSC, since you already passed 60 days. Did your name check is cleared from FBI?
 
Mine is NSC case

I am considering to call NSC to file a query but little bit scared to speed up negative responce (if it comes out negative). I tried to collect more info on NOID cases. Some ppl say that in their cases denials came out prety soon after response were send if they didnot find any merits there.

I just dont know what to do next.

I believe if they did not receive the information requested it is grounds for denial. Did you get copies of what was sent in the RFE response to see if the W2s were included?

I do not have the copies. Even if i ask for copies what if the attorney gives me copies of my W2's which were not actually sent. We have to trust attorney's word. I dont think there is much in our hands.
 
Do not trust attorney

You should have read everything before send out.
I trust my attorney but every time i find 5 typo and i logistic errors.
Another rule attorney should provide copies of everything he sends for your records. What if he dies tomorrow from heart attack?

I'm sorry to hear that. In our 140 RFE, I asked to see the exact contents of the accompanying lawyer letter. There were several spelling mistakes and content errors so it was good to do the check. I supplied all the content of the RFE response except the companies portion so I know what was included.
I wonder if calling the AILA or some other organization and filing some complaint about your attorney would help at all.
