We already posted in another thread about our I485 denial. There was no replies today... please help us in this situation....
We thought denial was due to the fact that our I140 was withdrawn. But we got the denial letter copy(it says copy since they already mailed the original on Dec 16th which did not reach anyone) yesterday and its totally a diff reason for our petition's denial. It says that my H1B was expired on Sep 19th 2003 and we filed our petition on Sep 23rd 2003. Actually my previous employer filed my H1B to be extended from March 2003 upto Feb 2004 (adding the no of days I was out of USA in the previous yrs) and it got approved by CA service center only a few days back(Jan 15 2005). My 6 year period expired on Sep 19th 2003 but at that time this H1B was still pending to be approved. So, I hope I was in status at that time. I just need to see the approval notice from the lawyer and I hope they approved for the entire period. If not, I will be in soup. The lawyer who I used is lazy and she got all my papers completed on Sep 10 2003 and took 13 days to mail them to VSC. Its her mistake to do that. But I did not worry about that too much since my H1B was still pending at that time.
Do any of you know how to reopen this. Because this notice says there is no appeal on this. I am not sure if my old lawyer can help me in this. Can I do it myself to do a MTR?
Its actually a mistake to say I was out of status by VSC. Because CA service center was processing my H1B at that time and finally got approved a few days back.
