i-485 denial!! i-290b pending on 2yrs now, help?

My I-485 employment based was denied in June 2006, I filled a I-290b motion to reconsider also in June of 2006.

I have gotten no response since then and have made numerous infopass appointments.
I have also written to the USCIS local office in Hartford, CT and to my local Senator and congress representative.
I have not recieved any relevant information on when my case will be reviewed, just that "IT IS PENDING and Awaiting Officer Assignment".

It is almost 2 YEARS now and still no answer, I have gotten 2nd opinions from other attorneys and they have said that the decision was wrong and the file should be approved, but none have said what I can do, but just wait for a answer.

Is there any help out there in getting a status? My EAD has been cancelled since 2006 and I dont know how long USCIS will take.

Can I file a law suit? any ideas for those that have been in situations or have an advice would be great. :confused:

Has your Senator sent e-mail enquiry on your case? He should and if he does they will answer him usually within 30 days.

You could contact the ombudsman's office, they may help

Think you can file a write of mandamus. So, what do your attornies advise you to do? and if they have no advise, then I guess all you can do is wait it out. But I suspect your case could have gone missing, two years is far too long

The senator got a response last October that the case was "Waiting Officer Assignment".
My attorney has said that we should wait till I get the FOIA, freedom of information information, the records that USCIS has on me so we can followup with a WRITE OF MANDAMUS. But im still waiting for the information to come back from the FOIA, that gonna take another 5-6 months.

I am thinking of going down to the USCIS, to have them really check if my case is in line to be assigned if they will do that. Also I think I will followup with the senator. But I dont really see this helping.

Oh Not to forget about the Ombudsman, they were NO HELP. They inquired last Jan 07, and they said my case would be responded to in Aug 07 and it was never was responded to. I contacted the Ombudsman again and they then said that the case is in line. So they gave me 2 different answers.:mad:

Also I took the letter from the Ombudsman to USCIS via INFO Pass and the officer said that it doesnt matter what they said, i have to wait for a response. :mad: ???????????????????????????????????
