I-485 case came back as rejected

hey guys,
my I-140 and I-485 along with advance parole etc, were filed and reached to USCIS on July 30, 2007. per their earlier circular they would be accepting all applications that were rcd on or before July 30 with the old filing fees.
but they erreneously sent the case back and i lost alomost 2.5 months due this error. the case was refiled and sent back to USCIS on Firday October 12, but there is no acknowledgement from them as yet.
my question is will the lost time be taken into consideration as it was error on USCIS's part. and when can i expect any movement on the case, as my H1 is up for extension and expires on Dec 17. should i be filing for an extension of visa?

please if anyone is facing similar situation, can you provide some answers.

USCIS will honour the receipt date (the day the case was received) to maintain an applican'ts status. However, that may not be available till you receive the notice (when the case in entered in the system). I would not wait any longer and would extend the current non-immigrant status ...
