I-485 approved.

Checked AVM last night. My and my spouse\'s I-485s were approved yesterday.

EB3 India
PD June 1999
RD July 2001
ND Aug 2001
FP Dec 2001

MY labor and I-140 were filed by an earlier lawyer who erroneously filed my EB3 I-140 for CP. Documents were sent to consulate in India in 2001. My new lawyer (company changed lawyers due to some problems with the previous lawyer) re-filed my I-140 in EB2 which got approved in September 2001.

However, we went ahead with the I-485 filing in July 2001 with the EB3 I-140 because we weren\'t sure when the new I-140 would be approved. We had filed the new I-140 only so as to cover the EB3 I-140 should the latter go into suspended animation in the event of a priority date retrogression. The lawyer also sent in new I-140 to INS to be added to my case record.

In May, when I spoke to an IIO, I was told that my case had been assigned to an officer and that they were waiting for my EB3 I-140 to return from the NVC. I called the NVC only to be told that my I-140 case was not in their hands anymore as the papers had gone to India. They said that the INS will have to retrieve them from the US consulate directly.

Well, finally our cases have been approved. I have to thank Mr. Khanna and rupnet.com for their concerted efforts in helping out this community (gc-seekers et al). I sincerely wish success to all those of you arduously waiting for your turns in this permanent residency process.

In my opinion, INS should have all the information...

In my opinion, INS should have all the information necessary to get your file back. When I called the NVC they asked me for my EAC# on the I-140 approval notice. If they can find out from that number where the files have been sent, the INS can too. I am not sure when they request that file frm the consulate. However, I do know that your case needs to be assigned to an officer first.

When I spoke to an IIO in May 2002, I was told that they are waiting for my I-140 and that it would take about 3 to 4 weeks for the adjudication. I have read somewhere on this forum that it usually takes a month or two extra in such cases. You may also check out the FAQs on www.murthy.com

Check if your case has been assigned to an officer. You may in fact ask your lawyer to check on your behalf.

Yes entering an invalid EAC# is probably the only way to get to a rep

I had to do the same. When we file our I-485 thru an employment based process, the I-140 notice has to be attached anyway. This is true even if the I-140 was filed for CP. I don\'t know why the INS has to wait for this I-140 to come from the NVC.
 
QMKWWTG i called NVC before i read your message !

after a long hearing message i could able to talk to a rep , she asked me my Case Number and she said on April 30th 2001
NVC sent my I-140 to Madras Consulate , she said its been almost an year so VSC might be having this with them by now . what do you
think ? My RD is 07/12 ND 08/27 FP 12/13

On May 17th when i called IIO she said my Case is beeing reviewing
it takes another 30 to 45 days ...!

on June 7th when I called IIO at VSC she said "every thing seems OK you will hear decision soon" ...! ...if they have any problem with I-140 she would have pointed this issue out ! isn\'t it ! any suggestions ???
