I-485 approved while current wage less than LC wage

Anyone out there who got I-485 approval while current wage is less than LC wage, say about 10% to 20% less? My current wage is about 10% less than LC wage and I’m afraid my I-485 will be denied because of this wage issue if RFE is issue.

My lawyer said that my company is required to pay the wage on the LC at the time of I-485 approval, but not before. And I don’t think that will happen (pay raise), cause I’m be getting pay cut all this while working for the company 3 ½ yrs.

Is there any BCIS or DOL law that required company to pay employee LC wage at the time of the I-485 approval as what my lawyer said above? I’m asking my lawyer the same question and will post his comment on this later.

I’m trying to get all the facts and figures right before talking to my company manager on this LC wage issue. Any comment will be welcome :)
 
Do not worry..., I got approved with 33% less salary than LC. Even after approval my company did not raise my salary to LC. I am not a fighting cock..., so I am trying to find a better position.....

& Kenki2 i'm in same boat too my current sal is 8% less then LC salary. Ive checked with posts & friends (all friends are "best immigration advisors") & my lawyer that LC salary is for future so you'll ge approved don't worry.
but the point to worry comes

1. if INS randomly checksback on ur case and finds that u r not making as much salary as u were supposed to then they might cancel ur GC and ask u to deport.
2. At the time of citizenship they might ask you to give w2s etc and finds that u didn't make as much money as u were promised; so they might take some actions.

Now both of these points I've "heard" from a close friend whose friend's friend was sacked with 1st point. (why does things always happen to friend's friend? inthis case i hope they do and don't happen to me) :)

Regarding your point 2..., take actions..., on whom???..., the employer is supposed to pay the promised LC salary (if one sticks on the to the same employer after GC...).

Well INS will take action against company which in turn affects you. INS will deport you saying that ur employer didn't pay as much it was supposed to, so they are trying to hurt employer that u can't keep this employee by taking employee away from him but ultimately poor GC holder gets canned.
 
This is the reply from my lawyer:-

Never heard those rumors, but you will have to be paid the pw at the time of green card approval.
***Company*** is requird to pay you the wage on the labor cert at the time of the lpr approval, but not before.

I agreed with unitednations on his last posting that's what my lawyer means.

So far i only got reply from peace_of_mind that he got approved with 33% less salary. But did he get RFE for EVL or any RFE prior to approval?

This posting also make me nervous as like what amcom said that we will have to take a risk at the time when our green card case is being touch, we do not get RFE for EVL

I will talk to my company manager about this wage issue next week and see what he has to say.
 
Yes there was an RFE issued..., only to confirm that I am still employed with the sponsoring company..., no wage questions... My employer answered as....the employment will commence after GC approval...,
reply to RFE was more simple in my case because..., I have not changed the employer. In case of change in employment, may be one should include the wage in the reply to RFE.
As far as the point raised by amcom..., regarding issues at citizenship time.., its after 5 years..., I will not worry about it now...
 
In in the same boat as many others

my salary is 16% less but benefits are very good when compared to my previous company. I also moved from High cost of living city to lower cost of living city. I dont know these would be taken into account before they approve gc
