I-485 for my wife and myself is approved. I received a letter from INS to go to local INS office for fingerprinting and other formalities.

My wife is in India now.
My wife's H4 and my H1-B is valid upto Sep-30-05

1. Can I go to local INS office now and my wife will go later (may be after 2 / 3 months)

2. After I-485 is approved, is there any time limit till how many days, we can go to local INS office to complete fingerprinting.

3. Will there be any problem if I go to local INS office and get my green card and my wife will enter U.S. through his H-4 visa later

4. After I go to local INS office ( I beleive they put a stamp on the passport too), is my H1-B wiil be still valid until I get my actual Green Card. Will there be any problem if go out of country in that period.

Other Info -
I-485 ND - Mar-2002 , Approval Date - Jun-2004

Myself and my wife don't have Advance Parole. My H1-B and my wife's H4 is valid until Sep-30-2005

sxaforum congrats on your approval

Your situation unique. My friend and his wife went on different day to get PP stamped like 2 week difference. They were in similar situation as you, she was in india, came back on H4 and got it stamped (after 2 weeks). So coming back on H4 is not an issue and also getting the PP stamped induvidually is not an issue either.

2 or 3 months after the approval is tricky.

For question 4, after stamping your are free and stamping is a temporary green card, you are a legal resident. H1B is really a mute.

Hopefully someone will help with a concrete answer. Please think about having her come here for stamping and go back to continue the vacation ...

Consult your Lawyer immediately

Once the 485 is approved, the H or L visa is no longer valid and may not generally be used to reenter USA.
