In fact, my green card journey started much earlier on November 26, 2002, when my employer submitted a special handling labor certification for college teachers for me to the California EDD. About a year and half later, the DOL San Francisco Regional Office remanded the application to the State for insufficiency in recruiting documentation. Then, it was sent to the Dallas Backlog Elimination Center, of course. The case is still pending there, as many of you in this forum are very well aware of; the 45-day letter was answered in a timely manner, etc. As a result, my older child (22) was aged-out somewhere down the road though the younger one (2) is included in my I-485 approval.
Now that my I-485 is approved, how do I go about sponsoring the aged-out child? His last entry to the United State was, on a student visa (F-1), on August 27, 2006. If I file I-130 for him now, what are the consequences? Would he able to travel overseas to take summer internship positions, etc., without having to worry about being stopped by the U.S. Immigrations Control at the airport upon returning, due to an immigrant petition filed by his parent?
Any input or suggestion will be greatly appreciated!
