I-485 approved - FINALLY!!!

Hi all,
My case has finally been approved as per the AVM.
Here are my details for all those interested
PD 06/98 (Other)
ND 09/99
First FP 06/2000
2nd FP 02/2001
Approved 05/03/2001 as per AVM

It has been a really long wait considering that my PD has always been current. However, I have been calling and talking to IIOs at CSC almost every other day for the past 3 weeks. Last week I also got my attorney to send an official inquiry via fax. Heard the message at the AVM and finally heard those magical words.

This has been a really great and helpful discussion group and I wish all those waiting good luck. I am also really amazed at Ciba for maintaining all the statistics of the approvals/green card etc. Great job Ciba keep it up!

My advise to you all is that if your application is as old as mine and you don\'t have the visa availability issue (meaning PD is current) then you should start following up on your case. It appears to me that until the time I did nothing my application was marked \'pending\' and thrown in some stack. The moment I started calling on a regular basis it seems they pulled up my application on top. It has been painful waits on the phone and talking to IIOs but it was well worth all the effort. I think personally calling and irritating them does make a difference and every one of us should be doing that to get an approval.

Forgot to mention that I filed in EB3 category and my wac # is wac-99-239-xxxxx.
It might just help others with similar ND/wac # etc.
Does anyone know the situation at San Jose INS for passport stamping? Is it possible to get an appointment or do we have to stand in long lines?
Is it possible to get passport stamped at any INS office for e.g San Francisco etc that are said to be less crowded?

Any help in this regard is highly appreciated.

Thanks a lot - yeah it has been a really painful wait but I am finally there.
I am not currently on your tracking list but please do add me to it. I have received the approval notice by mail and would try to go for passport stamping sometime this week.

The fax number for the INS inquiry line is
(949)389-3484 - I just got this from my attorney as she was the one who faxed it. I would recommend that if you have filed your case through an attorney then let them send an official inquiry as they know the format etc. On your part you should call the CSC on a regular basis. I know it\'s really hard to get through but it\'s for a really important cause.
In my case I always called between 8:30 and 9:00am and did always manage to get through(except one occassion :-)) and made sure I had all my wac numbers and the entire immigration file with me.

Why did you mention in your original mail that your
priority date was always current? If you filed in Eb3,
then your priority date became current only in may 2001.
Did you file your 485 during that \'phase\' inwhich everything
was current and then they retrogressed?
I believe INS processes 485 according to priority date
and not notice date or receipt date....thats why I think
you had a long wait, am i right?please clarify?

Hi Ravi,
I filed in the EB3(other) category - I was born outside of India but am an Indian citizen. I think the priority dates are based on the country of birth and that is the reason my application was accepted in the EB3(other) category according to the I-140 approval.
However, for some reason when the application reached some sort of a sorting process where they decide what stack to put the application - my application was put on the wrong stack. No amount of calling them would make them listen - they kept telling me that my application is pending because of \'unavailabiliy of visa\'. I hadn\'t posted this experience earlier but I got to speak to an IIO last week who seemed to be of Indian origin. I explained to him that my application is being confused because I am an Indian citizen and that priority should be on the country of birth. I think he talked to some other adjudicators and actually called me back late last week to find out some more information. The same day \'May 3\' my application and my wife\'s application was approved. I did my first FP in June 2000 - if my attorney would have listened to me and faxed the inquiry then I probably would have received my approval earlier.
Anyways, I am finally through and that\'s all that matters. I hope that answers your question.

I think you can go anywhere in CA. Few weeks ago it was a post from somebody that drove from San Jose to Westminster to get his passaport stamped. Check Ciba\'s web site under personal exp. It might be there.
