I-485 approved before adding spouse name.

Hi.
  My I-485 is being processed in the Texas service Center. Unfortunately my I-485 got approved before I could add my spouse name as follow on to my I-485. When I go my finger print notice my attorney asked me to go ahead and do the finger printing as it might take at least 2 months for the finger print and I had plans of getting my wife to US mean while. My hard luck my i-485 got approved in 10 days from the date of my finger print. Since my I-485 got approved before I could apply for the H4 for my wife my attorney advised me not to apply for H4 for my wife and asked me to do the CP for my wife in India as my marriage date is before the approval of my I-485 and my wife is in India. Is this the only way to get my wife to US and how long would it take usually to get the CP done for a case like this
in chennai counslate.

So heart less of you. This guy is upset over not being able to live with his wife just after marriage and you want your stupid tracker updated???
 
As long as you are married your date of 485 approval ...

you are fine. File for follow-to-join CP and you will be fine.

Why are you calling that a stupid tracker?? Some ppl here went out of there way to put up a tracker for the benefit of all of us who are waiting for I-485 approval.. and you call it a Stupid Tracker??

And look at that guy who says "hard luck my I-485 got approved in 10 days".. I would be elated if my I-485 got approved that quickly.. and he is complaining ???

adding wife onto I485

Even though Your Lawyer is correct on filing procedure for wife (filing I485 using follow-to-join process - wife has to be India
until she gets GC approved and has to come to US).
Also try to get H4 based on your H1 if you have larger leftover time in your H1 .. try following option that may not hurt I believe:

1. Do not go for Passport stamping for your I485 for now.
2 Get H4 for your wife based on the Your current H1-B Valid visa as long as your haven\'t travelled using AP or worked using
EAD.
3 If you have worked using EAD .. that means your H1 is invalid and you can\'t get H4 for your wife .. you have to go thro\'
follow-to-join method as long as you got married before your I485 got approved.
4. If step 3 is invalid - proceed further.
5. If you get H4 for your wife .. bring her to US without any ?s from consulate - try Drop box instead of face-to-face interview.
6. Apply I485 with your I485 receipt notice copy and all necessary docs immediately (marriage certificate etc.,).
7. Wait until you receive your wife\'s I485 receipt notice.
8. Once you receive wife\'s I485 receipt notice, then go for GC Stamping where ever specified.
9. Wait for wife\'s I485 approval.
Obviously - wishing you have a Happy Married Life.
Believe, this option is perfectly legal because unless you get passport stamped still your H1 is valid.
Still, check with your Lawyer on this whether you can pursue this option.

His wife can NOT get H4 visa as his 485 application is

approved and H1-B status is no longer valid.
Please do NOT even try to apply to H4, as this may fall under Fraud or mis-representation and could create problems.

Best thing for you is to file \'follow-to-join\' CP and present proof of marraige before US consulate office in your primary residence of your home country.

Can I get my passport stamped before I apply for the \'follow-to-join\' CP for my wife or should I wait till the \'follow-to-join\' CP for my wife gets approved/accepted.
Also if I file the \'follow-to-join\' CP for my wife can I change my company while the \'follow-to-join\' CP for my wife is under processing.
 
Still .. You can apply for her I485 - proven

Yes ..
* You can bring her to US using H4
* Don\'t go for your GC Stamping immediately.
* Prepare the Necessary I485 Derivative Documents for your wife - that includes your marriage certificate, birth certificate, affidevit of support etc.,
* Submit to INS service center.
* Wait until You get your wife\'s I485 receipt notice.
* Go for your GC Passport stamping ..

This happend to me .. I applied my 485 before marriage .. got married .. wife came here with H4 .. due to unavailability of visa date (in year 2000) end up in waiting till May 2001 .. by that time, my GC got approved just after my PD became current .. after 2 weeks
of my approval .. I went and applied I485 for my wife and got it approved last week (May 30th 2002).

Don\'t worry .. Be Happy .. as long as you got married before your approval and your spouse in H4 and IN USA, you can apply for I485
