I-485 Approved based on Asylee Adjustment

Hi all,

I am an asylee and political asylum in the USA was granted to me on June 27, 1998. I have filed my I-485 application on March 17, 2000 and it was approved on April 12, 2005. I have received the green card on July 12, 2005 and it shows this "Resident Since" date field to be 04/12/2004.

I am wondering why it would not be based on the date the asylum granted to me, 06/27/1998, instead of putting a trivial date?

I am asking the question because I know the I-485 adjustments based on refugees, the "Resident Since" date field shows the date they enter the countered?

I have already been waiting for over 5 years for this GC and now it looks like I have to wait another 4 years before I can apply US citizenship.

I appreciate all of the information that you can provide to me.

I have got the answer from the other threads. Wow, this is a great forum.

I guess the backdating thing is the law and we have to live with it until congress changes it.

i am in the same boat, but still haven't received my green card. Asylum was granted in Oct of 1999, filed my i-485 in Dec of 2000 (Live in California, so it's a Nebraska Service Center). Done fingerprinting, medical exam, etc and still waiting.. Can you please tell me first what service center did you apply to, and what is the procedure? did you have an interview? Or did they just mailed you the green card?

All I-485 appliications based on Asylees and Refugees go to Nebraska Service Center (NSC). My understanding is they are currently processing the November 2000 cases. I have seen people in those cases who have their applications return to them for additional information including an update of their medical examinations and the G-325 forms.

In my situation, I have applied on March 2000 and my finger prints were taken on 04/13/2004. I kept checking the status and until I found out an update in my case which they sent some of the forms back to me. I have provided the additional information that they have requested and they have approved my case on 04/14/2005, basically four days after they received the update. I have found that out on the online case status processing and also a letter in the mail. After about a month after the approval letter, they sent me another letter requesting a biometrics and a photo. I went to the local BCIS office and have the biometrics and the photo done on June 17, 2005. On July 07, they mailed the green card back to me. On July 12, 2005, I have received the Green Card in the mail.

My advice to you is call the 1-800-375-5283 and request an status update from NSC. Tell them to send it to you in writting. Also, make sure they have your correct address. If you have to give them your new address over the phone, ask them to send you a letter confirming that they have received and also send the AR-11 form to them. I have come across someone who did not give them his latest address, INS sent him a letter to his old address and it went back to the INS. About 6 months after he move out his old address and he has not heard from the INS, he went to the local INS office. He was told you did not keep your obligation to update the INS with your address changes and your Granted Asylum is revoked. He is currently going through the deportation proceedings. Things are strict lately!

Thank you so much... I didn;t think that I would get my Green card by the end of the year, but now it makes me hope that it would be faster. Thanks so much for the info and everything
