Good news that all EB categories are current now and can apply for I-485
I have few queries in regards to filing this I-485. It would help, if anyone can clarify or provide pointers to this.
My wife and I have valid H4 and H1 VISA stamping till Nov 2008 (I am in 9th yr extension). My wife in India now (traveled last year) to complete her studies.
Q) From what I have read, I guess she need to be in US to apply for I-485 along with me. or is there any alternative?
Q) If she has to come, can she come in (using her H4 VISA) for say a week or so, complete the paperwork and document for I-485 and go back to India immediately to complete her studies and enter back into US (using H4 VISA) without applying advance parole or EAD?
Q Can we choose to apply for Advance Parole after she is back permanently or do we need to apply now along with I-485?. If we have (or choose to) to apply with I-485, can she travel immediately just after applying without waiting for the parole to come (since she also has H4 VISA) ?
