I filed my Green Card as a depedent beneficiary on my husband's EB3 category and we're divorced recently. I was called for interview for AOS on my I-485 and case was put in pending status as there is a domestic violence case against my spouse. My attorney and INS Visa officer say that I can apply for AOS under Violence Against Women Act application if my husband had become permanant resident. I don't know whether my husband had obtained his permanent residency or not. Is that true? How long does this process take if I apply, is there a guarantee that I would be approved? Would there be a case at all for approval?
If I want to apply for my Green Card with my own employment, can I file separate case while this case is pending? Is this feasible? Can there be two cases pending with INS? I appreciate your responses.
