I-485 and H1b

Hi all,

I have filed I485 on August 3rd 2007 and my receipt date is Sep. 12, 2007.
I have also filed for EAD and AP. I have already received my EAD 2 weeks ago. Now, my lawyer called me today and advised me to renew my H1-b for another 3 years based on approved I-140. My H1-b will expire in December 2007. And I am totally confused now. Would I be having "double" status? Do I really need to extend my H1-B now after receiving EAD? :confused:

You should extend your H1 because it will allow you to leave and re-enter on H1 status or bring over dependents on H4. You can't work for another employer, though. You're not in "double" status; you are in H1 status. If you do use your EAD to get a second job, only then will you no longer be in H1 status and you will need AP to re-enter the US.
