Green card Gurus,

Please help me with the following situation:

My 140 is filed in Nov 2002 and I-485 is filed in Mar 2003.

The job situation in my company is not that good.

Should I apply for EAD ? (my lawyer did't suggest anything)

Does applying for EAD means that I have lost my H1 status ?

When can I change the company so that I can continue my GC processing? ( EAD approved / 140 approved / 485 passed 180 days ??)

Thanks

but ...

1. You can apply for EAD but you should decide if you need it, based on your job position, etc.

2. Applying for EAD does not mean you are out of H1 status. Only if you fill I-9 form with the EAD details, you are out of H1 status.

3. Theoritically you can change employment only after 180 days have passed after GC filing. But if your present employer will not withdraw your I-140, then you could change jobs even now.

Also bear in mind that, once you start working on EAD, you should also apply for Advance Parole if you have plans to leave the country.
