I-485/131/765 Documents

Dear folks,

How easy it is to file for I-485/131/765 on my own for both myself and my wife? Do I really need an attorney for that? Can someone tell me what documents do I need to have for this?

Also, is there a cover letter needed for this?

Very easy, you dont need an attorney for this. Read the instructions carfeully in the forms and make a check list of all the docs required, they have mentioned that very clearly in application instructions. Fill the form and submit.

I never put a cover letter with any applictions I had mailed to USCIS, no use. I wonder the contractors who process your applications ever read that.

Instead I always use filing sheet protectors (those clear vinyl sheet protectors you get in staples or office depot or office max or walmart) and staple and consolidate all documents pertaining to one application in each (this includes, check, photographs, supporting docs etc).

This is particularly important when you are filing multiple applications and sending all of them in single package.

Other than this I laser print and paste the checklist of all the documents and applications contained inside each sheet protector, so that they come to know what all I have attached with each application.

Depends upon what you need to do. There is nothing called HAVE TO FILL, except for I-485 other forms are just based on your requirments, you mau choose not to fill them at all if there is no need.

I 765 is for EAD. If you plan to change the job after 180 days of your filinf I-140 and your H1 is expiring and you cannot renew it for some or the other erason, then you should fill this form. But I would suggest you if it is at all possible to get your H-1 B renewed then keep that as yoru first prefernce rather than using your EAD to work. Same applies to your wife. EAD is good but it has 2 limitations:
1. It expires every year so you have to keep on feeding it with $200 ($180+ mailing fees etc becomes $200 currently and is shortly going to increase). SO you have to keep on getting it renewed every year or atleast 3 months in advance before your last EAD expires. ANd sometime there lazy USCIS guys dont get you new EAD withing 3 motnhs then you have to go to local INS office to get a temporray one, another hassel
2. If for some reason (which normally doesnot happen to people like us who have no crimila background of political links) your I-485 is denied then you EAD which was filed based on your pending I-485 atuomatically becomes useless, then you cannot work.

In this case H-1 is better as it is not affected by I-485 denial.

I-131 is advanced parol, which is required if you planb to visit your home country, it is good since it gives you objectionless permission to neter USA after your trip abraod. You can also try to get H-1B stamp on your visa to return if you a valid H-1B status but there are more chances of it being denied since by filing I-140 and I-485 you are consenting to become an immigrant so they may create problems for giving you an H-1B stamp at US consulate abroad.

As far as I rember you NEED to fill and attach form G-325A or G-325B (read it I forgot which one, I think it was G-325A for EB-1A) based on your category. This form should be attched along with I-485, it is I thin in quadruplate.

Lastly all above is just friendly advice do you DD before you file any application.

Thanks Mogambo1. Does the 180 days statute applies for EB1-EA case as well? My understanding was that since EB1-EA case is not linked to an employer, the beneficiary can change job anytime h/she wishes during the GC process. Is that correct?
 
Hi

If you are applying for EB1 (extraordinary ability) you don't have to worry about 180 days. If you are applying for EB1 (outstanding researcher) where your employer would sponsor and therefore you need to stay for 180 days.

Is affidavit of support for spouse application (I-134) a must even if she is working?

Is it advisable to prepare each application (I-485, I-765, I-131) standalone and send it in one packet or attaching only one copy of common evidence such as I-140 approval notice, I-94, passport etc. per applicant enough?
