I was in removal proceedings, then petitioned to have it terminated because my husband was filing for me. at the first hearing to terminate, the judge said he was closing the case administratively pending the outcome of the I-30 and that once it was approved, I wouldnt need to come in and my lawyer could have the approval put in so they could terminate the case. I had the I-30 hearing in January 2013 and got an approval imediately, however the judge who was on the case retired and the new judge decided to scheduled a court date for me to bring in the approved I-30. so we went to court today and presented it, but instead of just terminating, she said my passport showed the i had traveled outside the US and returned without inspection, so she could either terminate the case and then i return to her in 2015 to testify on what happened or she could terminate and send me to CIS to present my case before them. here is my problem. I did travel to canada twice while i was in status but on both occasions, my I-94 was never taken and I was never issued a new one on my return. Each trip was 3days long and when i called the immigration hotline, the lady i spoke to told me that the reason my I-94 was not taken or the reason i wasnt re-issued a new one was because of the duration of my stay. my dilema is how can i prove i was inspected when i have no proof of it and i cant find any documentation to support what the person on the immigration hotline told me.
