I-140 with LC substitution

Hi all
I am thinking of starting my GC process.

One of my (ex) colleague at the company was my batchmate (hence holds same degree/similar salary/similar skillset/similar work). He had initiated his GC, but was let go in May 2001. His LC later got approved (in Aug 2002).

My company is willing to use his approved LC so that I can file 140 - is that possible given the time difference? Are there any other issues I need to take care of?

Do you have to apply for substitution officially? If so whats the time-estimate it gets done in? Or can you just send the I-140 app with the old LC?

Ps: Does it matter if he was fired instead of a lay-off?
 
Help for LC Sub

Hi All
I am planning to apply for 140 with Labor Sub. One of the collegue in my firm left in Aug'01 and his labor got approved after that. My company is planning to use his labor and substitue it with my 140.
I just wanted to find out whether the match is appropriate or not. The salary and number of years of experience is perfectly matching mine salary and exp.
As far as eduction is concern my graduate degree is M.S. in Civil Engineering and on the approved labour is mentioned
Master in Computer Science or Engineering or Equivalent.
My lawyer is telling that since on the labour it says CS or Engineering or Equivalent, mine Civil Engineering degree falls under Engineering or Equivalent category and I will be fine. But after seeing so many post, I feel that they are very strict on Labor Sub cases.

So Jim or any other guys, I wanted to know whether if I apply 140 with the above labor what problems I might face in getting 140 approved?

Any suggestion or help will be appreciated.
