I-140 Under Appeal and H1-B Extention

My I-140 has been Denied and under appeal...H1-B getting expired on 29th Nov...can I apply for H-1 extension saying that my I-140 is under appeal and attaching the relevant document or can I simply apply for H1 Extension without mentioning about my I-140 being under appeal ? What are the chances that my H1-B will be extended ? Can I still be in status after 29th Nov ? I have completed more than 7 yrs in US now. Thanks !

Does that mean you have already got the 7th year extension and you will be applying for 8th year extension?
I got my 7th year H1 extension from NSC after my I140 got rejected after sending the Receipt Notice of the appeal for Motion to Reopen My I140. I would suggest that you send your MTR receipt notice when u will be applying for extension. And do a premium processing.
Also, I was told by my lawyer that once your 140 is denied then your 485 also gets denied and if you are don't have an H1 then you will be out of status. You must act fast to apply to apply for your H1 extension and get back in status if you haven't already done so.
