I-140 Tsc Rd 06/11/2004 Approved !

Just got a letter in mail saying that my I-140 approved !!! I have filed NIW (cancer research) being on the 2nd year of my J1 visa. So, do not believe to people who would say to you that J1 status is not good enough to get GC !

I have applied in June and still no approval on USCIS internet site. Got aletter in mail today, case approved on Jan26th 2005.

I actually usde DIY kit, which I bought online. Used all instructions from there, believe it or not it all worked out without RFE !!! So, I am very very happy !

Congrats. BTW, you can file I-140 while on J1 HRR, but must get the waiver before I-485 can be filed.
 
Good morning everyone !

I do not need a waiver, because I am not a subject to 212(E) (I am not a subject for 2 years staying home- said in my visa stamp). I am applying for I-485 now. I-140 I wrote 100% myself therefore, I was not so sure wether TSC was going to buy it and was silently waiting for their decision before spending more money on GC. And the person from international office where I work was very negative about my idea, saying that i am breaking my non-immigration intentions of J1 and spoil my visas in future , if my i-140 is not approved. However, TSC thought differently and they bought my writing...
I also want to add that really you do not need a lawyer, because all my friends who hired a lawyer wrote all the letters themselves. Lawyer just brings confidence to you. your ceredentials are still there. All you need is DIY kit and a couple of friends' petitions to accomplish your I-140. Moreover, people who once wrote their PhD dissertations are capable to accomplish writing themselves, as their level of writing, presenting and defending the case could be even superior than lawers'. In addition, noone knows your credentials better than your self. Just believe in yourself and do it carefully !


So my credentials include:

1. PHD in molecular biology from Russia
2. Predoc in japan (4 years)
3. 2 years Postdoc in Medical center (Houston, TX)
4. Member of AACR
5.Awards, honors, fellowships -7
6. Citations of my work -over 60
7. My papers 13, 10- first author, all respected international journals
8. Academic presentations (artistic exhibitions...) 6 international conferences
9. Evidence of command of high salary (my boss wrote a letter that my salary is the highest of the postdocs with my experience in our institution)
My research will benefit USA healthcare. I wrote 3 pages how it's going to help USA and personal statement which extacts tears from the reader.
10. Recommendation letters :

1 from my Boss from japan
2.from a Director of international school of medicien from Japan(boss of boss)
3. Director of the institute where I work from Russia
4. My american boss
5. My collaborator from NY (he knows my work, not a coathor)
6.Director of my department where I work in Houston


I also put the review of my grant application in DOD. Although I did not get my money for resaerch proposal, they praised my credentials and my work saying how important it is. There were some words of critism there as well. Nevertheless, I highlighted the best part of that review in my I-140 petition.

I hope that my experience will encourage everyone and will be useful for you preparation !

J1/J2 and 485

My wife and me were admitted in the USA on J-visa. My 140 was approved one year before under EA, and we filed 485. This week, both of us were sent RFE to provide evidence that we fulfilled two years home residence rquirements or were granted a waiver.
 
Looks like you were qualified and prepared your case well.

The problem with filing I-140 when you are on a status other than H1B/H4/L1/L2 would be that if the I-140 is not approved, you are in a limbo. Naturally anyone would be cautious of that.

Did you guys know about the 2 YHRR before you filed your I-485 ? I think that it should be clearly written in your passport ? Good luck with the waiver !
 
I was granted a waiver, and switched to H1. With my initial 485 petition, I submitted all the papers inlcuding the current non-immigration documents. However, I did not submit the approval notice of J1 waiver with my appication, for which I have been now sent RFE. Today I mailed the copy of the approval notice to NSC.
This indicates, if you enter on J1, you need to show that you have fulfilled the home residence requirement or have you waiver petition approved, regardless of your present non-immigration status. By the by the petitons were made by myself, therefore I did this mistake for not having much information.

It all depends on the strength of your case really. If it's very good it won't matter.

RFE's are becoming the thing of the past now - it's all the part of INS's drive to speed up the adjudication. So it's goona be outright approvals or denials from now on. Which is great for people with strong cases and not so great for people whose petitions are borderline.
