I do not need a waiver, because I am not a subject to 212(E) (I am not a subject for 2 years staying home- said in my visa stamp). I am applying for I-485 now. I-140 I wrote 100% myself therefore, I was not so sure wether TSC was going to buy it and was silently waiting for their decision before spending more money on GC. And the person from international office where I work was very negative about my idea, saying that i am breaking my non-immigration intentions of J1 and spoil my visas in future , if my i-140 is not approved. However, TSC thought differently and they bought my writing...
I also want to add that really you do not need a lawyer, because all my friends who hired a lawyer wrote all the letters themselves. Lawyer just brings confidence to you. your ceredentials are still there. All you need is DIY kit and a couple of friends' petitions to accomplish your I-140. Moreover, people who once wrote their PhD dissertations are capable to accomplish writing themselves, as their level of writing, presenting and defending the case could be even superior than lawers'. In addition, noone knows your credentials better than your self. Just believe in yourself and do it carefully !
So my credentials include:
1. PHD in molecular biology from Russia
2. Predoc in japan (4 years)
3. 2 years Postdoc in Medical center (Houston, TX)
4. Member of AACR
5.Awards, honors, fellowships -7
6. Citations of my work -over 60
7. My papers 13, 10- first author, all respected international journals
8. Academic presentations (artistic exhibitions...) 6 international conferences
9. Evidence of command of high salary (my boss wrote a letter that my salary is the highest of the postdocs with my experience in our institution)
My research will benefit USA healthcare. I wrote 3 pages how it's going to help USA and personal statement which extacts tears from the reader.
10. Recommendation letters :
1 from my Boss from japan
2.from a Director of international school of medicien from Japan(boss of boss)
3. Director of the institute where I work from Russia
4. My american boss
5. My collaborator from NY (he knows my work, not a coathor)
6.Director of my department where I work in Houston
I also put the review of my grant application in DOD. Although I did not get my money for resaerch proposal, they praised my credentials and my work saying how important it is. There were some words of critism there as well. Nevertheless, I highlighted the best part of that review in my I-140 petition.
