I -140 timings for nebraska

My company is using substitution labor for me for filing I-140.But they don't agree to file I-485 concurrent due to risk of I -140 getting rejected. So if they file in March for I-140 ,how much time will it take to clear I-140 from Nebraska if preapproved labor is from July 2003.

I-140 is not dependent upon PD (date of labor). Having said that, they go by the date on which I-140 is received (RD).Say if you apply for I-140 now and is received by them on Mar27th, then your RD is Mar 27, 2005.

I think, for non-current cases I-140 is faster than that of concurrent cases.
However, for concurrent cases I see backlogs from nov 2003 onwards. this means there are people who have been waiting for more than a year for I-140 to be cleared.

Apart from this, 485 is your application and you have to pay most of the expenses involved and I do not see why they are worried about I-140 being rejected causing problem for 485. Try and talk to them to file 485 together with I-140 as this gives lot of peace, as sometimes unexpected retrogression issues could delay filing 485.

NSC :

I-140 / I-485 ND : 04/20/2004 RD : 04/22/2004
FP Done : 09/03/04
EAD / AP : RD : 04/22/2004 AD : 06/15/2004
I-140 / I-485 - ?

Looks like USCIS is processing cases filed in Feb 04 though they have been saying for the past 1 year they are processing Aug'03.

Let's keep our fingers crossed.

Thanks for the information, since the lawyer fee for I485 are being paid by them and being substituion case there policy don't allow this. I tried everything but no luck . Anyhow thanks for the information ,appreciate the help.

What is the date of I140 approval for NSC?

Hi UK123:
It seems your I140 is approved. Is it true? It shows that your I140 was applied in Jun'2004.
I want to know did you apply in "EB3 category with sustitute labor"?

NSC seems to follow no rules. The immigration portal is showing some dates in Aug'2003 for last so many months.

I have no idea, but it will be great if some one can help me relax by giving positive feedback. My company applied for my I-140 on Aug/19/03 and its' june/05 now. I still have not had any updates from nabraska. So, basicly my question is low much longer will it take? Can anyone reply with an estimate.

You should enquire about your case. Now the official processing dates are 12/01/2003. You post issue here:

Bio metric: code 3- 10/02/2005 (me & wife)

I-485 LUD: 10/4/05 (self)
I-485 LUD: 10/4/05 (wife)

AP LUD: 09/14/05 (wife, approved)
EAD LUD: 09/21/05 (wife, approved)

11/07/05 - calles USCIS and started enqurity on I140 and it
takes one month to get the feedback)


Any one knows why delay on my I140?
