I 140 Thru LC substitution

Hello
Can I use an already approved LC(for another person) to file my I 140, if the job roles match?

What about the pay, Should it be the same as the one in the approved LC or can it be more than what is mentioned
Will it have any effect on the approval of 140 ??

what else should be taken care when you go thru this route
Any help will be greatly appreciated

The job title should match, salary the more the better but the most important one, atleast in the last few months has been the educational requirements. I have seen lot of substitute cases receiving RFEs on education match.

You can use an approved LC and substitute yourself only if:

a) The educational qualifications prescribed for the position
match your qualifications AS ON THE DATE OF FILING OF THAT
LC.

and.

b) You possess the prescribed work experience as mentioned in
the LC, AS ON THE DATE OF FILING OF THAT LC.

The salary that you currently draw is not a big factor at this point, but the company should be willing to give you the salary stated on the LC after you get your immigrant status.

Ask for a copy of the LC and look for the above information.

Your job title and the job cited in the LC should also be similar if not the same.

Education Match for subs. Labour

I have used subs. labour and filed I-140. I would like to know if in original labout educational requirement was Bachelor degree. But I am having master degree. Is I am having good chance of getting a RFE.???

It looks like the qualification you hold is higher than the what is
required in the LC. This is OK.

They would also look at the major and whether or not you have
this qualification AS ON THE DATE OF FILING OF THE LC.
