I-140 Straight Denial,

We have received a straight forward denial notice for I-140 (EB2) with USCIS contending that educational qualifications doesn't match US masters degree. Labor certificate education requirement is 'master's degree'. I have 3 years of graduation (B.Com.) and ICWA (equivalent to CMA or CIMA), then 2 years master's degree (MBA) from India. I have total 7 years of experience.

We think USCIS denied this case as 3 years India graduation is not equal with 4 years of US graduation, so planing to file an MTR with detailed evaluation of B.com or ICWA and documentation to show that it is equivalent to US 4 year's bachelors.

Anybody was in similar situation and please share how this can be handled?
 
A 3 year degree from India is usually not considered equivalent to a US 4 year degree for obvious reasons. If you can prove that ICWA is a "progressive" degree to BCom (that requires BCom as a minimum qualification) then you will have a chance with MTR.

Every case is different. However, we have had approvals when this is handled properly. There is an unpublished Appeals Office case approving the 3+2 as equivalent to a US Masters.
