I-140 Salary issue

Hi !

Now a day’s I-140 and I-485 have been rejected because of company’s inability to pay the salary.

In my case I have been getting salary as per H1-B labor which is less than what is on the green card LCA. With this new law of no RFE's will be issued, do you guys think that my I-140 & I485 case will be denied

It's great to have salary equal to prevailing wage. But looking at the forum I have notice that large numbers of beneficiary are getting salary less then stated in approved LC.

There are many factors to consider before evaluating RFE/Denial based on "Salary Issue". These are:

1) USCIS Officer looking at the case.
2) Difference in the salary.
3) Other financial papers submitted by employer.

I would say not to worry about RFE as none of the above factors beneficiary can change. Wait till you hear back from USCIS and act accordingly.
