I-140 Rfe

I need to submit my last 2 W-2s and Recent pay stub in response to I-140 RFE.
If the W-2 figure is less than the minimum H-1 wage, will I-140 be denied ??
My company is in good shape and has the ability to pay the prevaling wage. Company's bank statements and Tax Return will also be submitted along with my W-2 and paystub.
Has anyone else experienced the same situation ?

I don't think W-2 figures will be a problem. As the GC is for a future job.

However, if your GC (there by the labor cert. & I-140) are filed for the same job on your current H1.. I don't know of any body that went through that scenario..

I don't think that there is a Min. H1 salary as a rule. It is as per your contract with your employer and LCA reqmt. Also, it depends on other factors like.. the number of hours you have reported, any sick time, un-expected long vacation time (for.. ex, a trip to India) etc..

All the best with your RFE. Please post your ND & RD and the category like EB2 : Concurrent or CP option etc., so that we have an idea of the processing times at NSC.
