I-140 Rfe

On 28th Jan i recieved RFE on my I-140 petition applied on 14 Nov.

It says. Submit proof of beneficiery's foreign employment history. In addition to letters already provided, submit the original letters from copes were made, contracts and pay statements to verify beneficiery worked for listed employer.

I dont have pay-stub from indian-employers. Has anybody got this kind of RFE and what could be the solution.

I have never had INS request paystubs from former overseas employers. It sounds to me that they are suspicious about something. If I were handling the case the first thing I would do is THOROUGHLY review the file to see if I could find what INS believed was the problem. Then we would need to have a serious discussion. After I was satisfied that INS' concerns were unfounded, I would submit any additional documentation of employment that was available and explain why the paystubs were not available. You may want to consider getting all new employment letters and affidavits from former coworkers. Wpeak to your attorney regarding this since this is a serious situation and if INS believes that your documents are fraudulent, denial of the I-140 could be the least of your concerns.
