Hi,

I got a query on my I-140. My employer showed(offered) 85k while filing the labor but when he filed I-140, he showed 50k.

USCIS requested my employer to show additional funds to support the extra 35k . I spoke to my employer. he was saying that its a simple query and he can answer by showing net profits company assets etc etc. will it be possible to do like that, is that sufficient to support my case. Uscis requested my last 3 pay stubs also. Please advise on my case.

Make sure that you submit your last 3 paystubs including W2's from your Priority Date. If your employer mentioned 85K then you should be earning that much. You can show this proof through pay stubs and W2. On top of that your employer can show the net profits, company assets etc., Carefully review all the docs before you submit the documents for your I-140 query/rfe.

I really appreciate for your Reply. I asked my employer to do the same. he said he is going to create 3 pay stubs showing 85k salary. Hope everything goes well.
