I transferred my H-1B to present GC sponsed company in Nov 02, got H-1 receipt# in Dec 02, Joined my new job in Dec 17th, 02, got the 1st paycheck on Jan 15th, 03, So i don't have 2002 W-2 form with new company. I also applied for LC in Dec 02, got LC approval in May 03, then I applied for I-140/I-485/I-765/AP concurrently with receipt date of June 27th, 03. Now my attorney received an RFE for my I140 application requesting for
1. company's financial capability to pay..
My company has revenue of $6 million/annum and has more than 60 EE's in Payroll, so have all the required documents.
2.And also asking to provide my W-2 and latest pay stubs.
Since I always got paid on time so have all the necesary proof in the form of my pay-stubs, But w-2 form wasn't issued and i have my previous company W-2 for 2002 which i already submitted. I have provided the information to my lawyer regarding my first paycheck(ie, pay period of dec 15 - dec 30th, 02 & paycheck dt is Jan 15th, 03) and hope he will be able to provide the justice to the case.
Because i don't have recent W-2 form for 2002 with the GC sponsed company, is that cause problems?
My basic concern being that, could the request for a whole lot of information imply a higher probability of rejection?
