I-140 RFE...Please respond...

Hi All,

I received an RFE on my I-140 petition. Here it goes...

Evidence relating to qualifying experience or training should be in the form of letter(s) from current or former employer(s) or trainer(s), and should include the name, address and title of the writer. A specific description of the duties performed by the alien or of the training received as well as the beginning and ending dates of employment should be provided in the letters submitted. Experience/training received through prior employment should be documented by the prior employer. If such evidence is unavailable, other documentation relating to the alien’s experience will be considered.

The letters you submitted do not show the ending dates of your employment.


The experience letters that I submitted had all the information about the employer(name, title,sarting date,duties,tel,fax etc.,) except the job END DATE. It would be highly difficult for me go back to those companies and get the new experience letters. I don'e even know if those companies exist.

I would really appreciate if someone could tell me how to resolve this problem.

I'm not 100% sure of this (translation: check with your lawyer) but I think if you can get a notarised letter from any of your ex-colleagues at your old company it might be good enough. I hope you made friends in your old place! :p

I've one more question.

I realized that START and END dates of my previous job are not consitent with what was stated in my labor application forms (ETA form A and B). There is no GAP between the jobs but end date with old compnay and start date with the new company were shifted up by exactly ONE year.

For example, my LC says, START DATE: Jan 2000 and END DATE: Dec 2000. However, in my experience letter the end date is stated as Dec 2001, which is correct.

Does anyone know if this cause any issues?
