I-140 RFE on Education

RFE on I-140.

I have done 3 years diploma and got into 4 years bachelors degree program. BUT I got 1 year of credit due to diploma and started from 2nd year of program, thus finished 4 years bachelors in 3 years. Thus I have done 3 yr diploma + 3 year of Bachelors.

Now NSC has issued following RFE on my I-140. Any suggestion as how to respond to this RFE will be highly appreciated.

"Because the Form ETA-750 does not state that a combination of education,experience, and training is acceptable in lieu of the bachelor's degree, the evidence does not establish that the beneficiary meets the requirements of the labor certification because he does not have a single source degree that is equivalent to a bachelor's degree. You must submit evidence that the alien obtained the required bachelor's degree before july 10, 2003. Evidence of education must be in form of an official record showing the dates of attendance, area of concentration of study, and date of degree award, if any."

First Question : Is your educational evaluation done combining both diploma and your bachelors? I am also in the same boat I did my polytechnic 3 years and then engineering 3years. But my educational evaluation says only my 3year engineering degree is equivalent to US 4 year degree
Second Question: what is your ETA says in 14 and 15 column? Mine says Bechelors or Foreign Equivalent.

Did you check with your attorney?

No. Mine education eval says I have US bachelors equivalent.

Your US degree Equivalency = 3year diploma + 3year Engg? Is that how your evaluation done. If you have that copy if they mention like that then you have to re evaluate it probably?

Read through carefully you will know.
Also did you send your degree and transcripts while applying your 140?

I think KrishKish is right. They must have been confused by the evaluation letter. A proper evaluation letter should work for this RFE.

Do you think that a person having a 3 yr Diploma + 4 year engg(part-time) will get an RFE?

BTW is Kishore too.. I am not sure whether someone have 3 yr Diploma + 4 year engg(part-time) will get an RFE. After researching the forum I came to a conclusion that if your single source degree is equivalent to US degree you should be fine i.e. if ETA 750 says Bachelors or Foreign Equivalent. If ETA did not mention combinations then people like me will be screwed.

Did you have your credential evaluation with you? Check that and see the evaluation did not mentioned diploma + Engg equivalent to US degree. Mine did not mention anything like combination of diploma + engg = US degree.

Also alert your attorney about your situation.

So I have .001% hopes of not getting RFE. BTW did you get a chance to check you evaluation?

4-year part-time

Mine is 3 year diploma + 4 year part-time degree. I didn't get RFE in I-140. I-140 got approved, but it was in VSC. I think they don't care if it is part time or full time.

I checked my education evaluation today. It says that my Diploma counts as 40 credits towards BS. It also states that the 4 year BE (part time) is equivalent to BS in engg. from a US college. So I guess, it should be OK.

Hi ARV,
TSC, VSC and CSC are cool about educational qualifications. NSC sucks. They are very very strict on the educational part that is why I am worried. As of now nobody having 3 year diploma + 3 year degree mentioned they are approved. If any body with 3 year diploma + 3 year engg degree is approved from NSC please let us know and shed some light on us.

One more final question: What is your ETA says 14 and 15th boxes. Also College no. of years how many did it says? Mine says "X".

Hi Kishore,
The form which we include when we apply I 140. If you have all the set of papers then you will find that ETA form too. Also if you have your labor certification set of papers it will be there too.

I could not find the ETA form but I spoke to my parallegal today. She said that my ETA specifies 4 yr BS or Equivalent + 3 years of experience and that my evaluation clearly states that I have an equivalent BS. So everything should be fine. Lets wait and see what happens.

Just saw this and you will live 100 years. I was about send a congratulations message to you and saw your another post. My hearty congratulations. Looks like they are processing the third week of december. May be in next two weeks I may get an RFE or approval. Good luck on your 485 and good luck on my 140 and others.

Congrats guys. I am also in similar situation. My labor approved last week only. My PD is May 2004 India. I am planning for I-140 (EB2) & 485. I have two bachelors degree (BSc & BTech each 3 yrs duriation) after higer secondary. The BSc is the admission requirement for entry in to the BTech. So, my education pattern is 10+2+3+3. I have two evaluvation. Both says my second degree alone is equivalent to US BS degree.

The labor requires Bachelors Degree in my specialty (second B.Tech) and 6 years experience. It does not say combination of education is acceptable.
I am planning to apply in NSC.

What is my chance here? Should I enclose B-Tech Mark sheets along with I-140 application? Each mark sheets says it is "6-semester course". Your advise is highly appreciated.

First of all my 140 is not approved yet. If mine get approved then yours for sure. Also before we have user ItsGood. So if his application gets approved then ours will. My engg degree itself says equivalent to US degree that is the only hope I have. By any chance are your from Colorado? Before applying 140 please check with your attorney what are the consequences. Until labor everything will be ok but at 140 especially NSC they are very very strict. I cannot do anything right now. I am keeping my fingers crossed. Praying all the gods every milli second.

Looks like I have poor education evaluation as follows: "Degree of Bachelor of Engg (honours) and Diploma are equivalent to a Bachelor Degree from an accrediated University in the United States".

I spoke to couple of Education evaluators such as Trustforte, they said my single degree (BE) is actually equivalent to Bachelors in US. I haven't got Evaluation done yet, waiting for suggestions from Attorney.

But I believe everything should smooth sail if I produce single source of US bachelors equivalent evidence Should I try to get letter from Univ in India too ?

What is your specialization in Engg. Is it electronics or computer science? Mine is electronics and comm engg. and my evaluation is done in such a way that they have mentioned most of the subjects. Mine is two page evaluation.
