I-140 RFE for education

Hi All Gurus

Please help me!! I got an RFE from VSC asking for education evaluation. My attorney is not helping me and so I am very concerbed. I have a B.E. in Electronics Engg, and 8+ years of experience as Programmer Analyst. The LC states the rewuirement as Bachelors in Computer Science or equivalent. I found that for proving equivalence, we cannot show work experience, nor a combination of degrees. So what is my recourse here?

Any help would be highly appreciated.

I have also got an RFE and mine is NSC. There are lot of threads that have proposed solutions to this RFE. What I did is I sent photocopies of the degree certificates to trustfortecorp.com and many seem to have got this RFE taken care using the evaluated script done by this company. Send a PM for more information as what's been exactly asked by the NSC.

Did your attorney send the education evaluation with I-140? It should be OK if you send good evaluation. Since most of the subjects are common you can get equivalency.

No, my attorney didn't send any evaluation along with my I-140 as they said the labor was approved based on my education and the education evaluation falls in the DOL jurisdiction.

However, when the RFE came, I convinced my attorney and am in the process of sending a evaluated credentials transcript done by Trustforte.
 
No educational eval sent

My lawyer did not send an educational eval with the I-140 paperwork. But when I talked to Trustforte, they were not willing to show my degree as equivalent to comp science, although many subjects are common. Is there any other company who has done that for anyone before? I have seen a lot of threads where people got denied because box 15 in LC did not say if a combination of degrees or experience could be shown to prove equivalence. Has anyone had their case approved after such an RFE?

Mahesh, what is your degree in, and what does the LC say?


Please respond. I am very anxious and troubled.

I am also in the same boat. But, in my case I am trying to use a pre approved labor for substitution.

Pre approved labor says following in column 14 & 15
Degree: Bachelor's or equivalent
years: 4 years
Major field of study : Computer science

My education is from India
Degree : 4 years Bachelor's degree in Electronics and communication engineering.

I have to file my I-140 from NSC. My attorney feels that major field of study will be a issue as it mentions "only" computer science. I got a education evaluation done which says my education is equivalent to "Bachelor's in electrical engineering with specialization in computer sciecne". But, my attorney says we can't use this evaluation as it mentions computer science as specialization and not major field of study.

I tried with trustforte, but they cannot evlauate my degree to bachelor's in computer science. They told me that they can try to evaluate to "dual major in electronics and computer science".

hmnpa, did the trustforte people tell the same thing to you?. They asked me to send all the degree transcripts and mark the computer subjects. If I have taken enough computer science, then they can give me dual major evluation. As per my attorney such dual major evaluation can help, but still INS might not believe it and reject I-140. So, I am still looking for some suggestions on the board.

If you guys have any information about similar evaluation, then please share with me (PM will also do).

Mahesh, can you share with us the details of your evaluation and where did you get your evaluation done.

My RFE was on the education and the CIS had asked for any record that lists the date,attendance,etc proving that I meet the US education standards.

I have 4 years bachelor's degree in electronics engeering and need evaluated to bachelor's in computer science. What was your labor certification requirment and what was your degree?.

Labor certification was a new one and initially I had my bacherlor's in commerce and diploma in computers submitted. However, I graduated through online learning Master of Science in Information Technology from an UK university and submitted the same too. My RFE had mentioned about my bachelor's and diploma, but didn't say anything about my Master's. Also, the RFE stated I should have obtained the master's / sufficient education before July 16 2003 which was the date my labor was filed.


What did the education evaluation from trustforte state?

The education evaluation stated that I have education in standard with the US insitution and it also had the resume (about 2 pages) of the evaluator.

Thanks for the response. So, you got the evaluation from trustforte based only on your bachelor's degree and diploma?. I am curious to know what your education was evaluated to by trustforte. Was your education evaluated to bachelor's in computer science by trustforte?.

The evaluation was based on my Bachelor's, Diploma and also my Master's degree in Information Technology. The evaluation was done stating I have a Bachelor of Science degree with dual major in Computer Science and Business Administration.

My attorney is yet to send the evaluation in response to the RFE. How long does it take for these type of cases to be processed ? Any idea?

Hopefully, my attorney will respond this week to the RFE.

14 days

Hi Mahesh

after you submit the requested documentation, the service center will take 14 days to send a decision. If you have not heard from them in 60 days, you can call them.

Thanks hmnpa. Does it take 14 days just for the evaluation type cases or for any other kind of RFE?

My attorney haven't yet sent an response to the RFE as it seems they are busy moving to their new offices. Hopefully, they will respond by this week.
