I-140 RFE AND Approximate Approval Time

Hi All,
I got an RFE ON I-140 FOR Employer's Ability to PAY
I have heard that it is very common these days to get such an RFE.

Does anyone know, how much approximate time does USCIS Take to approve once you responded to such an RFE

Like most cases with USCIS, you never know. I am still waiting on the same issue. I had an RFE on Feb 17. Replied 3 weeks ago. No LUD/update whatsoever. Like they say, each case is different according to USCIS. But, don't expect any rationality as to why they are different. In fact, all the company financials were included with the whole package that was sent with the petition package. And the company is making profits running into 10's of millions per year with revenues in 100's of mils and there was still an RFE.

Satyavo, I amalso in the same boat. I replied the RFE on 1st march to TSC and waiting for the response. We better post here, once any one of us get some thing.
 
Its very common these days

I heard these days its very common to get this kind of RFE
Also one of my friend who works for A BIG FORTUNE 100 COMPANY, STILL HE GOT THIS RFE
 
I am in the same boat. Response to RFE received by USCIS on March 25. Web site updated with the RFE with Received status.
But today(03/28/05) there is a LUD Change.
 
I-140 for L1A cases

Can somebody guide me to the area of the forum for I-140 cases (and RFEs) for L1A visa holders.

I am going through the same problem. After 7 years I came to this stage and now got stuck with 140 RFE. God knows what happens next.From last 6 years I am working for the same employer.
I hope we all come out of this problem very soon. But we can’t do any thing other then wait (weeks or months or years….)

No updates from my end...

I am really frustrated with TSC. From past few day, I am completely disappointed.

Have patience. I totally understand the situation with taxes, pay-roll and indiffrent attitude of employer. I've been thru extreme of the situation on ability to pay RFE.

One thing I took care painstakingly after my first 140 denial is, keeping my pay-roll/stubs up-to-date. Having a decent conversation with employer how w2/pay-roll/stubs/taxes are crucial in decideing my GC decision. If I need to, used to call employer every day to keep pay-roll/pay-stubs with proper tax with-holdings. No exception for this, desi employers are big slackers on this and I'm the victim. Some times CIS may ask before 140/485 approval that about comapny's 2004 tax returns (if not sent) or w2.
Be preapred and have confidence that you have strong case than too much worrying on LUDs.

my service center is texas
i was asked company 2001,2002,2003,2004
w-2 for me and all the three employees in this small desi company
my employers letter
my labour certification ad in newspaper for 10 days
i submitted all to them but still no lud if they have received it or not..
i am optimistic until then...

Your suggestions are very helpful to me and this is a wonderful forum, it is giving some hope all the time.

My company is also a Desi consulting company with 60-70 consultants. They always have some profit.

I am worried about this because I got paid $10k less then in LC.
In the RFE they asked just about my 2004 W2 and company 2003 tax return.
Do you think it is going to be a problem?

'Ability to pay' is primarily derived from employer's tax returns which should have enough finanances to cover your LC wages. If not, USCIS asks beneficiary's w2 to make up your LC wages. One can not speculate/tell without looking at company's finances and w2 about 'Ability to pay' met or not.
There is a dedicated thread on this burning issue where 'ability to pay' has been analyzed to the extreme which is run by 'unitednations'. UN helped me in getting 140 approval, he's been a great help in rescuing my whole GC process.
