I-140 requirements

Hi All,

I had left Company A to join Company B. Company A had applied for my labor certification which got approved. Now, Company A is willing to apply I-140 for me, based on future employment, if I promise to join them once green card is approved.

Is this possible? What information/documentation is required by INS to apply for I-140/485. Is it required to prove current employment?

Please advice.

If company A is willing to apply I-140 for you, you are fine. Current employement is not related as long as you maintain the legal status. I assume you join company B by H1 tranffering.

Company B has transfered my H1-visa, also Company A has not cancelled the original H1.

My point of confusion is based on whether Company A can file for I-140 even when I am not their employee. Is this possible? And if anybody can share how different the paperwork will be in this scenario as against the regular one.

I think there should not be any difference. GC is always for the future job even if you are working for that company.
