I-140 rejected after submitting RFE to INS

I’ve the following question

My friend's company had filed a series of I-140 in last December and they got a RFE about the employer’s ability to pay. They’ve submitted the RFE and INS had rejected all I-140 applicants. My understanding is that either Company has done something wrong or may be the attorney dealing with INS didn’t go properly.

I'm thinking of joining the company and after hearing the denials from INS ,I'm a bit scared about it and wanted to know ,what’s the possibility of getting I-140/I-485 approved from the company with this kind of bad remark from INS.

Has any of you have through the above situation.Pls help me as I don't have much time left on my visa and I need to find out the proper info by the above description and which company to choose.

i-140 petition usually gets rejected due to employers inability to pay (very high propability) and next is employers prior violation of h1 or labor laws (very high propability) and the least change that the labor does not match beneficiaries skills or qualifications.

for your case the petition may have got rejected either due to inability to pay or labor scams. their corporation record shows their status as "restored to good standing" -> meaning they did not pay the corporate taxes properly or did not file their corporate returns in timely manner. the company seems to be in good standing now but who knows what uscis looks for in a employer to validate the ability to pay clause. second reason may be that their contact details in their website shows highly suspectable location of branch office. one would laugh out loud to see their contact details stating "satellite office" location. satellite office are nothing but virtual offices which dol or uscis treats as labor scam.

NEVER EVER state a company or individual real names in public forum whether in favor or not. i would suggest you to edit your post and remove the company name.
