I-140 Question

Hello all

My Lawyer applied for LC back in late 2003 , without noticing I have a 3 yrs Hons degree on Computer science since I was new in this arena I didnt know things.. anyways. about few months back he came back to me saying , My 1-140 will be denied due to LC containing strict text of requirement for degree US equvalent, (UNDER eb3 professional cat) . Now he insisted to me to file a all together new LC application using perm with ammended catagory like eb3 but under skilled workers catagory.
Ok now here is my question
Since I had 3 yrs Hon program .. back in 2003 (at the time of LC filing ) I went back to homeland ( Company opened an ofshore office) for about an year, and enrolled in 4 yrs Computer science program with successfully transfering credits for 3 yrs Hon Program. Now I have a 4 yrs US equvalent degree only difference is that I got it in spring of 2005 (Program completed Fall 2004).
Now lawyer is saying we cannot show this degree as an eligibilty for Professional Cat since at the time of joining My company I was not US degree Equavalent.
Is there any way we can use my Old LC which is still under process in anyway to avoid going through Perm Processing again??

Any pointers or help is greatly appreciated
Or How can I avoid delays in this situation??
