Hi guys, I need your help. I have been waiting for I-140/ I485 since Dec 03. EB3. I live in Virginia and my sponsor is in Chicago. Now, we agreed that I will start working for him as soon as I-140 is approved. My question is: What if NSC sends an REF for ability to pay, asking for pay stubs, W2, etc...? That is my concern since i have not started working for my sponsor yet. I will appreciate some strong feedback on this.

Hi PSilva,

I wish that you get an approval without any queries. Now, to answer your question, please keep in mind that GC is for a future job. You can be working for the same employer or work for a different employer when the GC is applied.

If there is an RFE for "ability to pay" reasons, then the same can be dealt with current financial statements and tax statements etc.. So don't worry about it. You attorney would know how to handle any query.

Hi Arvind I140,

Thank you so much for your explanation. I wasn't sure about. Hopefully our approvals come soon.
