I am on Company A's H1 (8th year extension). My GC is processed by company B, the labor of which just got approved two days ago. I am getting ready to file I-140.
1) Is premium processing available for I-140 in EB2 ?. (I was told it is only there for EB3. Just want to confirm.)
2) My visa expired in May 2006 and I-94 is extended till May 2007. I am travelling to India in Nov 2006 and have a visa appointment in Dec 2006. If I can get I-140 approved via premium processing before I leave, can I use it to get the 3 year H1 extension ?. Or, should I be on company B's H1 to avail that ?.
