I-140 processing times in VSC.

Hi All,

I came to know that some people are getting I1-140 approvals in 2 months some are in 3 months and some are in 6 and some are in 12 months. Does any body know why is this difference.

I called my lawyer and he told there are people who got I-140 approved in 4 months and people who got in 12 months . He told it is upto to the officer.

I filed mine in December 03 in VSC and had to wait and see.

Does any body has this same experience.

Everything based on your luck. A guy in our office got his approval in 21 days (EB2 ) ...

There is no FCFS (First come First Serve) here all are RCRS (Random come Random Serve) ..

So ... Govinda Govinda.

It's taking around 12 months on an avarage. If you are lucky enough like those who got in 4/5 months, then you will get it soon. But prepare for around 1 yr if not more.

I have applied by mid of May 2003 and waiting.
 
LOGIC for I-140 procesing at VSC

well it is hard to detect a trend with the processing of I140 aps. You are right some people get approvals in as little as 3-4 months while others wait for more than a year.

Based on your response and my guess it seems like the officers at VSC probably take an initial look at the applications after the 90 day period (as they are saying now that "it will take between 90-365days for any action on this kind of application" per Receipt Notice), and if it is a straight forward case (meaning if the application is "EASY") they approve it and if there are some complications like salary, degree evaluations or anything else, they probably leave it in the que.

I know for a fact that in the Labor application process they make this classification of applications.. I am thinking they probably do that in I140 too.. which might explain why some applications are approved earlier than others.. other than the fact that some applications are for Nurses which are approved much sooner than normal applications.

Can you guys confirm this with your lawyers???

There is small analogy in this, People with strong documentation and clean record of pay stubs and W2 along with company financial statements gets Faster 140 clearance.
Reason behind this is INS (Whatever New name is) should pre screen your entire application before issuing your EAD. at that time if you are lucky enough and the officer who ever screening your application get to see what all there in his check list your Application cleared then and there, May be this officer feels he doesn't have to deal with that application again then He clears it....

This is not just my assumption. This is happened in my case I applied 140 along with my co-worker whose wife works for law firm took all the care I mentioned in application and was cleared within 20 days where as mine took 360+ days....(NO RFE)
Final word is try to make it clean documentation and provide W2 and Tax returns at time that might help some times...
 
Does that mean

1. If i submit all the payslips and W-2 forms for all the years even thought most recent 3 months are enough.
2. I have to submit all the previous employer letters without any affidavits for substitution of experience letters. (for those whose employers are not in business and not willing to give us experience letters).
3. No errors in applications for I-140.

I submitted W2 and company Tax returns

If your analogy did'nt work out for me.
Mine is EB2 (master degree), and I submitted my W2 forms and Company's Tax Returns( Company has profits). But it still did'nt work out for me. I applied in April 2003, still waiting...
So there is no way we can predict how VSC approves I140...
 
140 trend few months ago

Actually, the trend noted this past summer was that if there was an inconsistency with the concurrent application such that the EAD filed along with the 485 generated an RFE for the 140 (for concurrent applications 0f 140, 485, 765 and 131, the give a once-over to the 140 before taking action on the 765), those people were deemed lucky, because a response to the RFE led to an immediate approval of the 140 (check the Apr/May/June filers for VSC thread)

Those who seemed to have complete and correct 140 apps (i.e., those of us who got the EADs without an RFE), seemed to have their apps fall through to the bottom of some god-forsaken pile.

At that time, we all were hoping that our EADs did generate an RFE on the 140 :D

Did I already mention that the USCIS is all screwed up? :p

USCIS Logic ?

Its really surprising to see the way USCIS works for I-140 for VSC cases. It seems every so called "LOGIC" seems to fail here. First people thought RFE cases are faster, then eventually we got postings of RFE delays. Then there was a boom about EB3 cases being processed faster which also cooled down soon. Then EB2 cases shown few sparks and it too died out. I think cases are just picked up randomly and processed at its own pace. Now x'mas season getting near very few approvals are taking place. Bottom line is try our best (in terms of filing petitions/enquiries) and leave the rest to fate hpoing some day big junk of approvals takes place.

Please show your magic, create a logic, so, everybody gets their I140 and I485 approved.

Sometimes, it is indeed frustrating dealing with BCIS. There is no logice, no method of tracking your case. It does not stop here, the processing time is increasing day by day.

One and half year ago, I485 were approved in 12 months +/-
6 months ago, I485 processing time increased to 15 months +/-
2 months ago, I485 processing time increased to 20 months +/-

It is satisfactory to have your I485 approved in 20 months. But, you can still live with it. But, the worst thing with BCIS is that it may push I485 processing time to 25 months +/- in next month.

It seems people working there do not have any accountability.

I have even stopped checking my status online.

BCIS not efficient enough to approve my case that quick.
