I-140 Processing Time - Update

During the last two months there has been virtually no progress in processing dates of any of the various I-140 preference classifications. The delays are a concern to numerous foreign nationals and their employers. Previously VSC expected to complete TPS applications by the end of January. More recently the center has informally advised that forward progress probably cannot be expected until after March 2003. Is this accurate? Can the center predict the rate of progress expected? What effort is VSC implementing to improve I-140 processing times?

TPS has had a lingering effect on the VSC, as the center was the recipient of over 150,000 renewal applications. The center has worked a way through those to a large degree, but still confront a list of shifting priorities. Both I-90’s and I-130’s have been identified as needing additional resources, while I-129’s have remained a constant beneficiary of attention. The center has recently implemented a process of adjusting the workflow to create constant, although somewhat small, flow of both 1st and 2nd preference I-140’s. This will provide some movement and, while not ideal, should give us some indication as to when certain dates could be worked. Further, the 3rd preference Schedule A Group 1 nurses are current. As the center tries and balances the priorities and manage the workforce, the center anticipates the addition of a number of adjudicative resources over the next 12 months. While these resources may not have an immediate impact due to training curves and requirements, they are in the pipeline and will provide some relief based on current workload.
