I-140 Premium Processing & I-485 Concurrent Filing HEEELP !!!

Hello guys,
I was planning to file concurrently I-140 and I-495 using also Premium Processing I-907 for the I-140.
I called USCIS and after they kept me on hold for 20 minutes to check this, they said that premium processing cannot be used when filing I-140 & I-485 toghether. I couldn't find anywhere on the internet that I cannot do that ! I understand that the premium processing is for the I-140 only.

Could anyone here please confirm whether I can or cannot file concurrently using I-907 premium processing for the I-140 and where to file ??


Please help ! I don't know what to do !

P.S.: I am thinking the filing address would be where they receive new I-140 + I-907's (premium processing).

The USCIS Premium Processing page does not mention that PP on I-140 is prohibited for concurrent (I-140 and I-485) filing. It says PP is unavailable for the following conditions:
1. A second filing of a Form I-140 petition while an initial Form I-140 remains pending;
2. Labor Certification substitution requests; and
3. Duplicate Labor Certification requests (i.e., cases filed without an original labor certification from the Department of labor).

Please talk to your attorney for a strategy. There are postings in this forum about upgrading I-140 to PP after the receipt notice was received for a concurrent filing case.

I know that the PP is not specifically excluded for concurrent filings but that's what the lady on the phone said (after checking for the address for 20 minutes).

I don't think is true especially because there are also posts in this forum about PP at the initial I-140/I-485 filing.

I just wanted to know if anybody did it and it went trough or maybe someone had issues with it... At this point I will apply like that anyway but I wanted confirmation....
