I-140 Pending since 20-May-03, Should contact Senator?

Hi,

My I-140 is pending since ND: 20-May-03 (EB3, VSC), BCIS web siteshows that they are processing Oct, 03 cases. I guess my employer and lawyer are not interested to put a case inquiry. And its employer petition, I can't initiate an inquiry. Should I contact a Senator?? If yes, please share any experience with NY senator.

Please advise.

I had the same issue. My I-140 was applied in May 03. After no approval till Mar 2004, I called BCIS, but they said they could only do a case referal if employer or attorney calls. My lawyer and company did not help much so I took matters on my own hand. I called BCIS and said I am calling from such and such company's HR and want to do a case status on 'MYcase' since it is pending well past the processing date. The rep said OK, and after taking details like co address, phone number, case number, did send it for a referral.
 
My I-140 EB3 is pending since Dec '02. My laywer made multipe status enquiry, but no use. Yesterday, I contacted the senate office. Let me see, what they can do about my case. Since last year, I was on lay-off list atleast twice. I have an excellent job offer from our competator, but I am not in a position to take the job becuase of this "stupid" I-140.

Did you call senete office? OR did you write a letter?
What is their response? Is it going to help? Just curious. Please reply.

I wish you good luck. But can't you change your employer after 180 days of filing I-140? I thought that's not a problem (provided the previous employer doesn't cancel).
 
I sent an e-mail to senator office and I am waiting for the replay.
I am working for MCI telecom. They are doing left-and-right lay-off . Who will I trust once I leave the company without my I-140. The manager who promised me to keep the I-140 alive might be layed-off next month.

This is what my lawyer told me

I don't think switching employers at this point would likely jeopardize your
green card process, as long as you will be working in the same or similar
occupation and as long as your current employer is willing to respond to any
possible requests for additional evidence on your I-140 petition after you
leave.

Immigration law allows a green card applicant with an approved I-140
petition and an I-485 application that has been pending for more than 180
days to switch employers without jeopardizing their green card status, as
long as they continue to work in the same or similar occupation for which
they were sponsored.

In your case, the I-485 application has been pending for more than 180 days,
but the I-140 has not yet been approved. Assuming the I-140 is eventually
approved, you should not have a problem. To my knowledge, the immigration
service's current policy does not require that the I-140 be approved before
you switch employers.

If the immigration service required additional evidence on the I-140,
however, your previous employer would have to be willing to cooperate with
the request. Otherwise, the I-140 could be denied and your green card
application would be jeopardized.

The safest course of action would be to wait until after the I-140 is
approved to switch employers. If that is not possible, however, I don't
think a switch before the I-140 would likely jeopardize your green card
application under current immigration policies. (I should note, however,
that final regulations on this law have not yet been published and the
policy could change in the future.)

Please notify us if and when you switch employers.
 
Yeah, it's hard to decide. I was laid off after 180 days without I140 approved (still not approved), my lawyer said that's not a problem, I had no choice anyway. But I am in good terms with my old employer so that doesn't worry me.
In your case I would patiently wait till 140 is approved as your lawyer seems to suggest. If you get laid off then you will have no other choice to think about.

Wow!! what a relief!! Just now I got an e-mail from my lawyer , my I-140 Approved .. after 18 months !!!!. I think his query triggered the approval.

Yes, now you can change your id to to 'fedup' and aftter you get 485, just let it be 'up' or 'fed' !
