I-140 Pending for 360 days and above!

If your I-140 is pending for >= 360 days please present your ideas. We should all unite and prepare a separate petition for our case.. It is really unfair on their part to process the later cases bypassing older cases like ours.
 
Inconsistent Proceesing at VSC

The fact of 140 processing at VSC is so inconsistent that as many people you will ask that many different views you will get.

My case is 140 filed on 5/28/02
ND:5/29/02, Approved:5/28/03

AP: 12/02
EAD:12/02

485:
ND: 10/07/02
no replies, no approval.
FP: 12/04/02

I had taken advantage of concurrent filing ang filed 485 in early October with the I-140 reciept. When my lawyer had sent a rep to VSC they gave the BS that because you have filed concurrently your I-140 will be processed along with I-485. We all know that this is a white wash to thwart the inquiries for 140 which is
currently taking as long as 13 months. There have been few instances as posted on this forum where they have approved I-140 in 22 working days!!!

If BCIS were to keep their words, my I-485 should have been approved along with I-140. But that did not happen!!!

What I have noticed in few instances is that if you apply concurrently and your application for EAD and AP are pending while they do a primary review of your I-140. At that point if there was a need for a RFE on I-140, then some IIOs will approve your I-140, after receiving a satisfactory reply on RFE. So this gives the impression that concurrent filers are getting approval faster.

On the other hand, if your case is very strong then they would put it at the bottom of the pile. Again this may be dependent on the which IIO gets your case and what are the priorities for VSC at that time.

Another thing that is yet not clear is that for those lucky/unlucky filers like me, "What date will be considered as filing date for I-485?". Will they consider I-140 date as the filing date for concurrently filed I-485 or the actual date of I-485?

It looks like they(BCIS) have different priority and budget problems from time to time. So it is impossible to find a coherent policy. After 9/11, in the name of security they can cause unexplainable delay in processing of normal forms, but they are not answerable to anyone. After all this is the same agency with new name who approved the case of terrorist leader Mr. Atta's visa 6 months after he caused historical devastation to this great nation and humanity!!! IIO's would rather delay your case, then take any chance that may appear as their mistake!

So in short go ahead and do file concurrently unless you are planning for consular processing or AC-140.

Can you please post starting digits of your EAC number Just for curiosity sake have you called INS If yes when and what was the answer?
 
Called BCIS!!!!!

I spoke to a lady today morning and after getting the EAC# from me, she was reading the same message what we see on the website.... She also told that my case (June 12th) will be taken for processing next week. (One of their standard replies!). If it happens, it should be a miracle!!!
This is the first time i am calling their 800 number and for some reason there was a time gap between my questions and her answers. I felt like talking to some one in India!!!

Did you represented yourself as a beneficiary ? Because when I called the lady did not even took my EAC number to discuss and said they can discuss the case only with the Lawyer who is representing my case. Is it like some reps will talk to you and some wont ? can u please clarify

Generally, they talk to the beneficiary or Attorney...

But, today the lady whom I spoke to didn't ask anything like whether i am the beneficiary or not...... She just got my EAC number, read the same info what i see on the search results. Then i asked her when my case will be taken up for processing, she told 'in a week'.

In all my previous experiences with VSC, i always got a reply that only the beneficiary or attorney can enquire about a case.....

Bad old days are back in INS

I also got the standard status reply. They did not ask me if I was the beneficary or attorney.
I think INS- at least VSC- is back to the good old hell of 2-3 years ago- delay delay and more delay and then some more.

Be prepared to call the BCIS..... It will be better if your attorney or employer calls and enquire on your status...
 
Snowbell , I don't have the EAC number the attorney refuses to give it .
Anyway hoping to get some response , atleast in this month and I also BCIS is prompt on the processing dates (not backtrack ) posted and max of 360 days for I140 (not extend anymore).

Completing 1 year tomorrow!

My 140 is pending since June 11 2002.................. No news!!!
It took almost 3 years for me to get the Labor certification.... Guys who joined my employer less than a year ago, filed 140 with substitute labor got their approvals...... I really don't know what is happening at BCIS!

Hopefully your case might be approved by this week, if BCIS stick on to max 360 days processing time. Anyway are there any EB2/ EB3 cases peding > 360 days
 
Spoke To IIO on the New Ph. No. 1800 375 5283

I called the IIO today morning. She told me her name and she was very nice and took my EAC no. and told me it is taking 30 -360 days. I told her I applied on June 6th last year.

Then she asked, whether she should put in a QUERRY, I said OK. Then she asked my full name, nationality, birthdate, address and she told me that I will hear from the BICS in 3-4 weeks, max.

What is going on?.

Did any one came across this???.

Do we have to lose our hopes on 140 application , based on the postings I don;t see an end to the May/June 140 applications .
