I-140 Pending and AC-21?

I am one of the unfortunate members  of the forum. My I-140 has been pending since 4/03 (Sub Labor PD-2000). I-485 has been pending since 06/2003. Now I am in a situation with my employer that I can't continue anymore beyond April. Can I invoke AC-21 ? What are the risks?

Also, the lawyers I am dealing with is so lazy to follow-up (they give more reasons than they breath). How do I change the lawyer w/o jeoperdizing the process? Any recommendations ?

Hi b_123,

It's very bad to know your situation. Yes its really bad. Well i saw some friends in this forum who sent AC21 before I140 approval. One of them is "painful140". He is very helpful. You can send message to him. Well i'm sending you that thread may be it will help you. You can get some information from here. In between if i know something more i will let you know.

your best bet is to take your current sponsoring company in good faith and get an assurance from them that will NOT withdraw your pending I140 as well as respond to any RFEs. If neither of that happens, then you will be in a problem ..

you can join new company and transfer your H1 (if u have time left on it) and need not inform CIS about it. Once your I140 is approved, then you can invoke AC21 only if asked by CIS.
good luck!
