I-140 overdue 6 mos at TSC.

I filed I-140 on 10/20/2003 (ND), EB-1 outstanding researcher, and I-485 in Jan. 2004, both with TSC

Both my family and I received approval notice for EAD and Advance Parole. We submitted finger prints in October, 2004.

My lawyer filed a status inquiry about my I-140 and told me TSC "is currently waiting to go through the FBI namecheck".

Please help me with the following three questions:

1) Is it normal to take so long to do the namecheck?
2) Does CIS ask FBI to do name check before issuing Advance Parole (which I already got).
3) What can I do to speed up this process?

2) Yes
3) Not much. Two months is not long in CIS time.

I was told on one occasion that the name check duration depends on how common your name is, which sorta makes sense since if your name is Li, the database is bound to return more than a few hits.

Thank you for your response. I contacted another lawyer and got a different answer about this. The second lawyer said that I-140 has nothing to do the name check. But the first lawyer insisted that name check is necessary for all I-140 applicants. Who is right?

I got my first Advanced Parol last year and renewed it this year (I received the AP renewal last week), which means that FBI has at least checked my name twice. Why are they so slow if this is the third time checking my name?

I don't think I140 requires name check, unless they can do name check without your finger prints as there is no FP requirement for I140.
 
Every Petiton Requires Name Check

I agree with lamonte. My I-140 OR petition was filed on 03/13/03. Recevied a Request for Information for I-94 NSEER Registration/FIN number on 06/19/04, submitted the I-94 which was recived by TSC on 07/02/04. Waiting since then. I was told it is due to name check.

The name check is nothing to do with the FP
