I-140 out of processing time

My I-140 (EB-1/OR) has been pending (no LUD at all) in VSC, since it was received (ND: 9/15/05). Anyone can shed some light on what could be the cause?

I had patiently waited till they posted the new processing date, but I was disappointed they didn’t move an inch so I am able to place an enquiry.

Anyone has some idea what a long pending case usually leads to denial? RFE? or approval eventually? My wife’s OPT is expiring. I am really on a hot pan. :o

2) Is your application well prepared?

I think it takes longer for a private employer and also if poorly prepared application.

LUD:12/1/05
after that nothing....still waiting.
 
Absoutely not! Once the case is received by USCIS it is all treated equal.
once the processing dates reaches, the case is assigned to officer.
now the the chances of delay after that... rely a lot this officer who is working on ur case. pplu, 7-8 months is reasoable time to wait for I-140 ...I am sure you will hear soon.

Also, if it gets unreasonably delayed then you can contact senator and start a congressional enquiry.
 
I am working in a well-respected company. We have many Ph.D.s (all of my group are Ph.D.s in my field).

I was asked to check the materials before the company filed the petition (prepared by a very experienced lawyer). I think it was well done.

My background isn't that bad either. At least the average of those approved I am aware of.

No idea what the heck is up there.

Yes? How did you know? I thought they have some kind of sorting beside RDs. Imagine that a large insitution filed a bunch of such petitions ...

The officer has no pressure? I thought there should be some guidance telling the officer how many he/she should finish per day ...

pplu, I am trying say by saying "absolutely no" is that it "delay" does not depend on private or goverment employer! Also poorly wriiten petition can led to RFE......
 
OR approved today (self-prepared)

My OR application (140 + 485) was received by VSC on 9/20/05. EAD & AP were approved in October. NO LUD after October.

I-140 approved in the morning - I have received an email :) .

Background-
Ph.D. (non-US) in organic chemistry
Currently group leader in a medium size pharmaceutical R&D Co.
17 publications + several conference papers (I dont have record/abstract of those)
Approx. 60 citations
My research has been discussed in two book chapters and several review articles
12 reco letters (1 from senior director, one each from Ph.D. advisor/postdoc advisors, several independent letters from academia & industry - US, Canada, UK, Spain, Japan)
Reviewer in good journal
Royal Society of Chemistry membership
No major awards

My application was SELF-PREPARED :cool:

When I contacted a couple of very popular attorneys, either they asked for $6k+ filing fees or recommended PERM instead of OR :D

I had absolute confidence that my case was not weak - IMO, it was better than many other approved cases that I know about. So I started reading articles, forums (including this one), some regulations, AAO decisions and worked on my petition. I argued strongly for original contributions (by citing portions from reco letters), publications (citations, book chapters, high-standard journals) and membership. Also I briefly mentioned the smaller awards and journal review.

I want to thank the very knowledgable contributors to this forum, especially eb1doc, honkman and others. I appreciate your encouragement and guidance to others.

Now I am hoping for a quick and positive outcome of my 485 application. Good luck to everyone waiting for an answer from the USCIS. Please stay positive.
