Hello all.
I am a contractor of a software development company located in the US. I reside in Uzbekistan, work remotely from home. I'm the only employee of the company in Uzbekistan. Also there is a lot of other remote employees especially in Russia. All they work in their homes. The US office is the only office of the company.
Now I would like to immigrate with my family to the US. The company will invite me to the US office with joy.
According to uscis.gov web site there are two cases apply to me:
EB-2. A professional or skilled worker (I-140 form).
EB-4. Special immigrant: international organization employee. (I-360 form).
---
EB-2. This category requires the company to get the Labor Certification. But this is IMHO impossible since there is plenty of software developers in the US (please correct me if I'm wrong).
---
EB-4. The question is can I be considered as international organization employee? It should be mentioned that my employment is purely legal, the company pays income taxes. Also the company is well known in its scope of activity. My contract with the company is available.
Please, confirm or deny my reasonings.
Thank you in advance.
P.S. Sorry for placing this thread to the "I-140 issues" category. I didn't found any category related to I-360 form or special immigrants.
