I-140 not approved, 485 transfered to Local Office Detroit, what it can possibly mean.
1) Would I get interview from them
2) I-140 should be cosnidered as approved
3) What actually going on...
Please post your comments I'm leaving for India soon for vacations for a month, Please advise...
 
Guys,

I am in the same boat, only difference is my I-140 is pending after a RFE and my
I-485 transfered to local office.I might get a interview call in a month or so and i am not pettly clear with my case.

1. What would happen during the interview if officer finds out my I-140 is pending ?

2.Does he have the right to adjudicate both the cases ?

3. Did anyone in this forum had this experience ?

Hey Guys,

I am in a similar situation as you guys. My concurrently filed 140-485 case (March 04 RD) was transferred to a local office in Miami in July. I have not heard anything about my case since. The problem with my case is that I am from Atlanta and am not sure why the case is in Miami. My 140 has not been approved either. At this point I am inclined to think that my case has been transferred by mistake. My lawyer is in touch with an AILA liasion and there is also talk of a congressional inquiry if needed.

If you are in the same jurisdiction as the local office, your cases might have been transferred for interviews. I have seen 140s being transferred to local offices and everything getting approved after an interview.

My understanding was if the case got transfered to local office , officers from regional processing center cannot do anything on transfered case this according to my lawyer,Correct me if i am wrong.

Here is what you need to do, take a infopass appointment with Miami office and speak with immigration officer and explain him the mistake. More you delay more time it takes to correct the mistake.

Was there any RFE on your cases ?

Thanks for your advise. The latest I heard was the TSC is asking for my case to be sent back to them. The National Service Centers can take back cases if they wish. This is what I am hoping has happened. I will give it one more week and then may make a trip to Miami to see whats going on. I am in Atlanta and hence its not easy for me to get to Miami.
